By using Wishy, you agree to these terms of use. Please read them carefully.
1. Acceptance of Terms
By creating an account or using the Wishy app, you agree to these terms of use and our privacy policy. If you do not agree, do not use the app.
The service is provided by Boysenberry (Chamber of Commerce number 42016252), operating under the name Wishy.
2. Description of the Service
Wishy is an app that allows you to, among other things:
• create and manage gift lists (wish lists); • share lists with others (such as family or acquaintances) via a link; • draw names (secret Santa) for groups; • reserve gifts for others; • generate gift ideas using AI features (see section 3).
Wishy offers a free version with limited features and a Premium version with additional options. Wishy does not sell products itself. Links to web shops are for reference purposes.
3. AI Features and Automatic Suggestions
Wishy may offer features that automatically generate suggestions, including a gift idea generator. Doing so involves the use of artificial intelligence and third-party search or processing services (such as via Google / Firebase). How personal data is processed is described in our privacy policy.
You acknowledge and agree that:
• AI output is not personal advice and may be incomplete, incorrect, or outdated; • suggestions are not verified by Wishy before you see them; • you are personally responsible for verifying prices, availability, suitability, and reliability of products and providers before making a purchase or sharing; • Wishy is not liable for any consequences of following AI suggestions, to the extent permitted by law.
You may not use AI features to generate or distribute illegal, misleading, or offensive content.
4. Premium Subscriptions
Wishy Premium is a paid subscription with extra features, which include, among other things:
• unlimited gift lists; • unlimited gifts per list; • unlimited secret Santa draws per month; • up to 50 participants per secret Santa draw.
Subscriptions
• You can choose a monthly or annual subscription. • Prices are displayed in the app and may vary by platform. • Payments are processed through the App Store (iOS) or Google Play (Android). • Your subscription automatically renews unless you cancel it. • You can cancel your subscription at any time through your App Store or Google Play account settings. • Upon cancellation, Premium access remains active until the end of the paid period. • No refunds for periods already consumed or expired, to the extent permitted by the rules of the respective store.
Consumer Rights
• As a consumer, you may be eligible for a statutory cool-off period of fourteen days from purchase, depending on applicable law and store rules. • For questions about your subscription, you can contact us at hello@getwishy.app.
5. Your Account
• You are responsible for your account and login credentials. • Use a valid email address that belongs to you. • Do not share verification codes with anyone. • Report suspicious activity to us immediately. • You may have a maximum of one personal account per person.
6. Permitted Use
You may use Wishy for personal, non-commercial purposes. The following is permitted:
• creating gift lists for yourself or your family; • sharing lists with others by sending a link; • drawing names for holidays or other events.
7. Prohibited Use
You are not allowed to:
• post false or misleading information; • share illegal, offensive, or harmful content; • use the app for spam or unsolicited advertising; • harass or threaten other users; • bypass the security of the app; • use automated scripts or bots (except as explicitly permitted by the app); • upload copyrighted material without the legal right to do so; • commit fraud or scams.
8. Your Content
• The content you create (lists, gifts, photos you upload) remains yours, within the limits of the law. • You grant Wishy a license to store, process, and display your content to deliver the service. • You are personally responsible for the content you post. • Wishy may remove content that violates these terms or the law.
9. Shared Lists and Links
• When you share a list via a link, anyone with that link can view it (depending on how the service technically displays it). • You are personally responsible for whom you give the link to and where you post it. • Shared information can be saved or forwarded by recipients. • Protect links if you want to prevent unintended people from viewing them.
10. External Links
Wishy may contain links to external websites (web shops and product pages).
• Wishy is not responsible for external websites. • Purchases are made directly with the web shop, not with Wishy. • Always verify the reliability of a web shop. • Some links are affiliate links. If you buy something through such a link, Wishy may receive a commission. This normally costs you nothing extra. Wishy does not sell products itself.
11. Availability
• Wishy strives to ensure good availability of the app. • Wishy does not guarantee uninterrupted access. • Wishy may perform maintenance or modify features. • Wishy may terminate the service with reasonable prior notice where possible.
12. Termination
You can delete your account via the app settings.
Wishy may terminate or restrict your account if you:
• violate these terms; • abuse the app; • harm other users or the service.
13. Liability
Wishy is provided “as is”. Wishy does not guarantee that:
• the app will always function without errors; • all information is complete or up-to-date; • the app will meet all your expectations.
To the extent permitted by law, Wishy is not liable for:
• loss of data due to technical issues; • indirect or consequential damages from using the app; • conduct of other users; • issues with external websites or stores; • AI-generated or automatic suggestions and their consequences.
Nothing in these terms limits liability that cannot be limited by law.
14. Intellectual Property
• The Wishy app, its logo, and design are protected and belong to Boysenberry / Wishy or its licensors. • You may not copy, modify, or reverse-engineer the app, except to the extent permitted by law. • You retain ownership of your own content, as described above.
15. Modifications
Wishy may modify these terms of use. In the event of significant changes, Wishy will:
• inform you via the app or by email; • give you the opportunity to review the changes.
If you do not agree, you can delete your account and stop using the app.
16. Applicable Law
These terms are governed by Dutch law. Disputes will be settled by the competent court in the Netherlands, unless mandatory consumer law prescribes otherwise.
